Product Listing Policy

GENERAL PROHIBITIONS

1.1 You are not permitted to post or sell any item that is restricted or prohibited by federal, state, or local laws in any country or jurisdiction. The Santhai e-commerce platform, which includes but is not limited to the web and mobile-optimized versions of the websites identified by the URLs “Santhai.market”, “Santhai.ca”, and the mobile applications of the Santhai Sites (collectively referred to as “Santhai”), operates as a global marketplace. Consequently, the sale or listing of certain items may be regulated or restricted due to the legal requirements of different jurisdictions.

Below is a list of some prohibited or restricted item categories. HOWEVER, THIS LIST IS NOT EXHAUSTIVE. AS A SELLER, YOU AND YOUR AFFILIATES ARE RESPONSIBLE FOR COMPLYING WITH ALL RELEVANT LAWS AND REGULATIONS in any jurisdiction, including the country of origin, the country of destination, and applicable international conventions such as labor laws and standards.

Your responsibilities include, but are not limited to:

Providing any required licenses, product certificates, or testing reports
OBTAINING necessary registrations or permits
ENSURING THAT NO PROHIBITED ITEM ARE LISTED FOR SALE

Unless otherwise stated, the list of restricted or prohibited items applies to all transactions conducted on Santhai.
For the purpose of this Product Listing Policy, any transaction supported by Santhai shall be referred to as a “Relevant Online Transaction”.

1.2 Santhai has also chosen to restrict the listing of certain items that, while not necessarily illegal, may be considered controversial. These include:

(a) N/A

(b) Items that are racially, religiously, or ethnically offensive, or that promote hatred, violence, or intolerance based on race or religion

(d) Stocks, bonds, investment interests, and other securities

(e) Pornographic materials or items of a sexual nature

(f) Listings that do not offer a tangible product or service for sale, such as digital currencies or advertisements intended solely to collect user information

1.3 Santhai reserves the exclusive right, at its sole discretion, to impose further restrictions and prohibitions as necessary.

1.4 In the event of any inconsistency, ambiguity, or conflict between this policy and other terms on the Santhai Sites, or between the English version and translations of this policy, the English version shall take precedence. Santhai’s decision, made in its absolute discretion, will always be final.

RESTRICTED AND PROHIBITED ITEMS

1. ILLICIT DRUGS, PRECURSORS, AND DRUG-RELATED EQUIPMENT

1.1 Santhai strictly prohibits the listing or sale of narcotics, tranquilizers, psychotropic substances, natural and synthetic drugs, steroids, and other controlled substances. Engaging in such activities may result in account suspension or removal.

1.2 The sale or listing of any drug precursor chemicals is strictly forbidden.

1.3 Items classified as drug paraphernalia, including any products primarily designed or intended for the production, concealment, or consumption of controlled substances, are not allowed on the platform. This includes, but is not limited to, ingestion tools such as water pipes, carburetor pipes, chamber pipes, ice pipes, and bongs.

2. FLAMMABLE, EXPLOSIVE, AND HAZARDOUS MATERIALS

2.1 The listing of explosives, as well as related ignition and detonation equipment, is strictly prohibited. Violation of this policy may result in account removal.

2.2 Radioactive substances, toxic chemicals, and poisonous materials are strictly banned on Santhai Sites.

2.3 The sale, purchase, or listing of hazardous or dangerous materials—including items classified as dangerous goods under the International Maritime Dangerous Goods Code—is not permitted on Santhai Sites.

2.4 Ozone-depleting substances are strictly prohibited from being listed.

2.5 Any product containing harmful substances, such as asbestos, is forbidden from being listed, sold, or purchased on Santhai Sites.

2.6 Fireworks, firecrackers, and similar explosive items are not allowed for listing on Santhai Sites.

2.7 Due to their explosive components, automotive airbags are strictly prohibited from being listed on Santhai.

3. WEAPONS, FIREARMS, AND AMMUNITION

3.1 Santhai strictly prohibits the posting, sale, or purchase of any weapons designed to incapacitate or cause serious harm to others, such as stun guns, batons, and crossbows.

3.2 The sale or offering of any services, instructions, or assistance in the creation of biological, chemical, or nuclear weapons, as well as other Weapons of Mass Destruction (WMD) or related agents, is strictly prohibited by international law and, consequently, on the Santhai platform. Any breach of this policy will result in Santhai notifying relevant government authorities and delisting the account.

3.3 The posting, offering for sale, or offering for purchase of arms, munitions, military ordnance, weapons (including explosive weapons), and related parts and components, whether integral or otherwise, is strictly prohibited. Violations will result in the delisting of your account.

3.4 Santhai does not permit the posting, offering for sale, or offering for purchase of replica, “look-alike,” or imitation firearms, and related parts and components, whether integral or otherwise. This includes air guns, BB guns, paintball guns, harpoons, spear guns, and other similar weapons that discharge projectiles containing gas, chemicals, or explosive substances.

3.5 Santhai reserves the right to remove any listing that it determines may be classified as a weapon, based on its discretion.

4. CONTROLLED ITEMS

4.1 While the listing of most knives and other cutting instruments is allowed, certain items are strictly prohibited, including switchblade knives, gravity knives, knuckledusters (whether bladed or not), bladed handheld devices, and disguised knives.

4.2 Santhai strictly prohibits the posting, offering for sale, or offering for purchase of controlled items that pose a risk to personal safety, such as restrained knives.

5. GOVERNMENT, LAW ENFORCEMENT, AND MILITARY-ISSUED ITEMS

5.1 The following items are strictly prohibited from being listed:

(a) Clothing or identification that claims to be or closely resembles official government uniforms.

(b) Law enforcement badges or official law enforcement equipment issued by any public authority, including badges from any government.

5.2 Police uniforms, insignia, and vehicles are not permitted for listing unless they are obsolete and do not resemble current police-issued items. This must be explicitly stated in the listing description.

5.3 Certain police-related items may be listed on the Santhai Sites if they comply with the following guidelines:

(a) Authorized general souvenir items such as hats, mugs, pins, pens, buttons, cuff links, T-shirts, money clips that do not resemble badges, and paperweights without badges.

(b) Badges that are clearly not genuine or official (e.g., toy badges).

(c) Historical badges that do not resemble modern law enforcement badges, provided that the listing clearly states that the badge is a historical item that is at least 75 years old or was issued by a defunct organization.

5.4 The following mass-transit-related items are prohibited from being listed:

(a) Any article of clothing or identification associated with the transportation industry, including but not limited to commercial airline pilots, flight attendants, airport service personnel, railway personnel, and mass-transit security personnel. However, vintage clothing related to commercial airlines or other mass transit may be listed if the description clearly states that the item is at least 10 years old, is no longer in use, and does not resemble any current uniform.

(b) Manuals or other materials related to commercial transportation, such as safety manuals issued by commercial airlines or entities operating subways, trains, or buses. These items may only be listed if the description explicitly states that the material is obsolete and no longer in use.

5.5 Santhai strictly prohibits the posting, offering for sale, or purchase of uniforms, equipment, and other products that could be mistaken by the public for military or police supplies.

8. RESTRICTED ADULT CONTENT

8.1 The posting or sale of pornographic materials is strictly prohibited, as it violates laws in many countries. While defining pornography can be subjective and standards vary across nations, Santhai adheres to guidelines accepted in Sri Lanka.

8.2 Items depicting or suggesting bestiality, non-consensual acts, incest, or sexual content with graphic violence, degradation, or minors are strictly forbidden.

8.3 When reviewing content for removal from the Santhai Sites, we consider the overall context, including images, text, and descriptions.

8.4 While the sale of sex toys and related products is permitted, listings must not include nude or sexually explicit images.

10. UNLAWFUL SERVICES

10.1 Listings that claim to offer government-related services or products are strictly prohibited. Examples include:

(a) Official government-issued identification documents, such as birth certificates, driving licenses, passports, and visas.

(b) Completed applications for any of the above-mentioned documents.

(c) Materials, equipment, or processes intended for the production of government-issued identification documents (e.g., driving license holograms, passport booklets).

(d) The sale or purchase of textile quotas is strictly prohibited on the Santhai Sites.

10.2 The posting or sale of any type of invoices or receipts, whether blank, pre-filled, or value-added, is strictly prohibited on the Site.

10.3 Santhai does not allow listings offering financial services, including but not limited to money transfers, issuing bank guarantees, letters of credit, loans, fundraising, or funding for personal investment purposes.

10.4 Listings created solely for the purpose of collecting user information or soliciting funds are strictly prohibited.

10.5 Listings offering medical or healthcare services, including but not limited to medical treatment, rehabilitation, vaccination, health check-ups, psychological counseling, dietetics, plastic surgery, and massage, are strictly prohibited.

10.6 The posting or sale of bulk email or mailing lists containing personally identifiable information—such as names, addresses, phone numbers, fax numbers, and email addresses—is strictly prohibited. Additionally, the sale or distribution of software or tools designed for sending unsolicited commercial emails (i.e., “spam”) is not allowed.

10.7 Job postings that allow a factory, company, or institute to recruit employees directly are prohibited on the Site.

10.8 Santhai is an online business-to-business information platform; therefore, personal and non-business-related information is not permitted.

10.9 Non-transferable items may not be listed or sold on Santhai. This includes, but is not limited to, lottery tickets, airline tickets, and certain event tickets that are restricted from resale or transfer.

11. COLLECTIONS, ARTIFACTS AND PRECIOUS METALS

11.1 Santhai strictly prohibits the sale or purchase of currency, coins, banknotes, stocks, bonds, money orders, credit and debit cards, investment interests, financial warrants (whether in digital or intangible form, such as cryptocurrency), or any similar products that could be mistaken for such items. Additionally, the sale of tools, methods, equipment, or materials used to produce, counterfeit, or modify these items is strictly forbidden.

11.2 The sale of counterfeit versions of the items listed in 11.1, as well as legal tender and postage stamps, is strictly prohibited.

11.3 Reproductions or replicas of coins listed as collectible items must be clearly marked with the words “COPY,” “REPRODUCTION” or “REPLICA” and must comply with all relevant local laws.

11.4 The sale or purchase of gold, silver, and other precious metals (excluding jewelry) is strictly prohibited.

11.5 Listings that offer rough diamonds or “conflict minerals” originating from non-compliant countries are not permitted.

11.6 Artifacts, cultural relics, historical grave markers, and related items that are protected under the laws of the PRC, the United States, and other jurisdictions may not be posted or sold through the Santhai Sites.

12. HUMAN BODY PARTS, REMAINS, AND PROTECTED FLORA AND FAUNA

12.1 Santhai strictly prohibits the listing of human body parts and remains. This includes, but is not limited to, organs, bones, blood, sperm, and eggs. However, items made from human hair, such as wigs for commercial use, are permitted.

12.2 The listing or sale of any species or any animal parts (such as pelts, skins, internal organs, teeth, claws, shells, bones, tusks, ivory, logs, roots, and other parts) that are protected by the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) or any other local law or regulation is strictly prohibited on the Santhai Sites.

12.5 The listing or sale of poultry, livestock, and pets is prohibited on the Santhai Sites. To clarify, live animals are not allowed to be listed on the Santhai Sites.

13. OFFENSIVE MATERIAL AND INFORMATION DETRIMENTAL TO NATIONAL SECURITY

13.1 Any and all publications and other media containing state secrets or information detrimental to national security or public order are prohibited. Such activity can result in your account being delisted.

13.2 Any information supporting or advocating infringement of national sovereignty, terrorist organizations or discrimination on grounds of race, sex, or religion is strictly prohibited on the Santhai Sites. Such activity can result in your account being delisted.

13.3 Postings that are ethnically or racially offensive are prohibited on Santhai. Sellers and purchasers must ensure that any wording used portrays appropriate sensitivity to those who might read it in their postings, and when they are offering or purchasing potentially offensive items or services.

13.4 In certain cases, materials of historical significance or essential to the item (such as a book title) may contain offensive words or phrases. Santhai retains the sole discretion to remove such items and encourages all members to treat others with the same respect they would expect.

14. TOBACCO PRODUCTS AND RELATED ITEMS

14.1 The posting of tobacco products, including but not limited to cigars, cigarettes, cigarette tobacco, pipe tobacco, hookah tobacco, chewing tobacco, and tobacco leaves, is strictly prohibited.

14.2 The posting of nicotine and other liquids (e-liquids) intended for use in electronic cigarettes is forbidden.

14.3 Equipment used for tobacco processing and the production of tobacco products may only be listed after providing appropriate production and sales permits to Santhai.

16. PROHIBITED AND SANCTIONED PRODUCTS

16.1 Any products prohibited by laws, regulations, sanctions, or trade restrictions in any relevant country or jurisdiction globally are strictly forbidden on Santhai Sites.

16.2 The listing or sale of petroleum, petroleum products, and petrochemical products is strictly prohibited.

16.3 The listing or sale of coal, iron, iron ore, gold, titanium ore, vanadium ore, and rare earth minerals is strictly prohibited.

16.4 The listing or sale of crude oil is prohibited.

16.5 The listing of any product subject to import prohibition or restriction is prohibited on Santhai Sites.

17. HAZARDOUS OR SUBSTANDARD ITEMS VIOLATING LAWS/REGULATIONS/POLICIES

17.1 Items that have been identified, warned, or recalled as substandard or risky products by recognized quality inspection bodies, manufacturers, or regulators are prohibited on Santhai Sites.

18. PRODUCTS INELIGIBLE FOR CROSS-BORDER SALE DUE TO THEIR NATURE

18.1 The listing or sale of products that are banned or restricted in specific countries is strictly prohibited.

18.3 The listing or sale of alcohol, food, and beverages is prohibited on the Santhai Sites.

18.4 Products that are unsuitable for cross-border sales due to their nature, such as fresh fruits, fresh vegetables, raw meat, and raw fish, are prohibited.

19. CONTROVERSIAL OR SENSITIVE PRODUCTS THAT VIOLATE SOCIAL MORALS, PUBLIC ORDER, GOOD CUSTOMS, AND HUMANITARIAN PRINCIPLES

The listing or sale of controversial or sensitive products that may violate moral, humanitarian principles or breach the basic norms of society are strictly prohibited. This includes, but is not limited to, items such as abortion tools, genetic products, products related to animal or organ cloning, items connected to animal or human experimentation, or products that may cause harm to the environment or society.

20. OTHER PROHIBITED LISTINGS

20.1 The listing of products containing harmful substances (e.g., toys with lead paint) is strictly prohibited on the Santhai Sites.

20.3 Used Products

(a) The sale of used undergarments is prohibited on the Site. Other used clothing may be listed, provided it has been properly cleaned. Listings with inappropriate or irrelevant descriptions will be removed.

20.4 Contracts and Ticket Restrictions

(a) You are responsible for ensuring that your transaction complies with the law and does not violate any contractual obligations. Before listing an item on the Site, you should carefully review any contracts you have entered into that may restrict your right to sell the item. Certain items, such as airline tickets, may have terms that limit your ability to sell them. Additionally, if you are distributing a company’s products, you may have signed a contract that restricts your ability to market those products.

(b) Santhai does not actively search for items that may pose contractual issues, nor can it review private contracts or mediate contract disputes. However, we want to make you aware that listing items that violate your contractual obligations may expose you to legal risks with third parties. As a result, Santhai strongly advises that you review any relevant contracts or agreements before posting items and ensure you are legally permitted to sell them on the Site.

(c) If you have any questions about your rights under a contract or agreement, we highly recommend reaching out to the company with whom you entered into the contract and/or seeking advice from an attorney.

20.5 Resale policy for event tickets

Santhai permits the listing of tickets to performances, sporting events, and entertainment events, as allowed by law. However, as a ticket seller, you are responsible for ensuring that your transaction complies with all applicable laws and the terms specified on the ticket.

20.6 Sale of Stolen Property

(a) The posting or sale of stolen property is strictly prohibited on the Site and constitutes a violation of international law. Stolen property includes items taken from private individuals, as well as property taken without authorization from businesses or government entities.

(b) Santhai supports and collaborates with law enforcement efforts to recover stolen property and prosecute responsible parties. If you believe that your images or text have been used by another user without your permission, or that your intellectual property rights have been violated, please contact us.

PROTECTION OF INTELLECTUAL PROPERTY RIGHTS

1.USE OF FACES, NAMES, AND SIGNATURES

Items that feature the likeness, image, name, or signature of another person are prohibited unless the product has been created or authorized by the individual whose likeness, image, name, or signature is used.

2.COUNTERFEITS AND UNAUTHORIZED REPLICAS

2.1 The listing of counterfeit, non-licensed replicas, or unauthorized items, including but not limited to counterfeit designer clothing, watches, handbags, sunglasses, and accessories, is strictly prohibited on the Site.

2.2 Products that bear the name or logo of a company but are not originally produced or authorized by that company are prohibited from being listed on the Site.

2.3 Listings for branded products are permitted only if accompanied by a certificate of authorization from the brand owner.

2.4 Listings offering the sale or purchase of replicas, counterfeits, or other unauthorized items will be removed by Santhai.

3. SOFTWARE POLICY

3.1 Academic Software

(a) Academic software refers to software offered at discounted prices for students, teachers, and employees of accredited educational institutions.

(b) Only authorized sellers may list academic software on the Site. Any unauthorized listings may be removed by Santhai before publication.

(c) Sellers posting academic software on behalf of an authorized educational reseller or institution must clearly state their authorization in the listing. A valid certificate of authorization from the reseller or institution must also be submitted to Santhai.

3.2 OEM Software

(a) The listing of “OEM” or “bundled” software on the Santhai Sites is prohibited unless it is sold together with computer hardware. Original Equipment Manufacturer (OEM) software, also known as bundled software, is typically provided as part of a new computer purchase. OEM software licenses generally restrict resale without the accompanying computer or, in some cases, without any computer hardware.

4. PROHIBITION OF UNAUTHORIZED INTELLECTUAL PROPERTY COPIES

The listing or sale of unauthorized copies of intellectual property, including but not limited to pirated, duplicated, backup, or bootleg versions of software programs, video games, music albums, movies, television programs, photographs, or other copyrighted works, is strictly prohibited on the Site.
